The rules for providing free legal aid have changed

The Minister of Justice of the Republic of Kazakhstan, by his order dated February 10, 2021, amended the form of the agreement on the provision of state-guaranteed legal assistance, reports zakon.kz.

It is about providing legal assistance.

According to the rules, a lawyer provides state-guaranteed legal assistance in the form of legal advice, as well as protection and representation of the interests of individuals in courts, criminal prosecution bodies, government agencies and non-governmental organizations:

  • persons brought to administrative responsibility;
  • plaintiffs and defendants in accordance with the civil procedural legislation of the Republic of Kazakhstan;
  • suspects, accused, defendant, convicted, acquitted, victim in accordance with the Code of Criminal Procedure;
  • individuals on the collection of alimony, the appointment of pensions and benefits, rehabilitation, obtaining refugee status or candas, minors left without parental care.

If necessary, attorneys prepare written documents of a legal nature.

State-guaranteed legal assistance is provided to Kazakhstanis free of charge.

Payment for the state-guaranteed legal assistance provided by a lawyer and reimbursement of expenses related to legal advice, defense and representation is made from budgetary funds in the amount established by the Government of the Republic of Kazakhstan.

The administrator transfers budgetary funds to the lawyer’s bank account within the time frame established by law to be paid for legal assistance provided and reimbursement of expenses related to defense and representation.

Previously, these funds were transferred to the account of the bar association.

The form of the Agreement has also been changed. It is formed in the Unified Information System of Legal Aid, comes into force from the date of its signing by means of the electronic digital signature of the parties and is valid until the end of next year.

The order comes into force on March 5, 2021.
